Arkansas VA IRRRL: Wet Funding, Dower Rights and Shoppable Title

What a VA streamline refinance looks like in Arkansas, including the title insurance fee you can actually shop. Home Loans Inc is not licensed in Arkansas, so this is education only.

Home Loans Inc is not licensed in Arkansas and cannot take a Arkansas application. We lend in South Carolina, North Carolina, Virginia, West Virginia, Florida, Georgia, Alabama, Mississippi, Iowa and Wyoming.

Straight answer up front

Not licensed in Arkansas. Still worth five minutes of your time.

I run Home Loans Inc, and we are not licensed in Arkansas. I cannot take your application and I am not angling to. What I can give you is the stuff the mailers leave out, so the lender you do hire in Arkansas has to earn it.

Money moves at the table

Wet funding, which is a nice change

Arkansas is a title and escrow state that funds wet. The lender wires money at signing, and it is held through the rescission window before the old loan is paid. Compared with the dry-funding states out west, the timeline feels cleaner. You sign, the funds are already sitting there, and the federal right to cancel on a primary residence runs its course.

Remote online notarization is generally available in Arkansas too, which is handy if you have already moved on from Little Rock and need to sign from somewhere else. Just remember the dower point below. If your spouse has to sign, both of you need to be on that video session or in front of the same notary, so line it up early.

The fee most people never shop

Title insurance is open market here. Act like it.

This is the part that can actually save you money. Arkansas is an open-rate state for title insurance, meaning premiums are not fixed by the state. Lenders often hand you their favorite title company and you never ask. Ask. Get a second quote. On a streamline where every dollar counts toward the recoup test, this matters.

On the tax side, there is no mortgage tax and no transfer tax on an Arkansas refinance. Recording fees are the only government line item, so title and lender fees are where the fight is.

Dower, curtesy and your spouse

Why your spouse signs even on a refinance

Arkansas still has dower and curtesy, plus homestead rights. Under ACA 18-12-403, the spouse joins the deed of trust to release those rights, and that applies on a refinance too, not just on a purchase. So even if the VA loan is only in your name, plan on your spouse at the table or on the notary call.

Foreclosure in Arkansas is non-judicial, and the state caps prepayment penalties at 3, 2 and 1 percent within the first 36 months. Mostly trivia for a current borrower, but good to know. The practical takeaway is simpler: two signatures, one title quote you shopped yourself, and a clean recoup number.

Who this is for

Little Rock AFB, Fort Chaffee, Pine Bluff and everybody who moved away

The biggest Arkansas VA crowd orbits Little Rock AFB in Jacksonville, where the 19th Airlift Wing trains C-130 crews. There is also Fort Chaffee Maneuver Training Center near Fort Smith and Pine Bluff Arsenal. Growth up in Fayetteville and Bentonville has pulled in plenty of veterans with VA loans as well.

Wherever you are, the IRRRL rules do not change. You need at least 210 days from your first payment due date and six monthly payments made, whichever is later. Costs must be recovered through monthly savings inside 36 months. There has to be a net tangible benefit. The funding fee is 0.5 percent unless you receive VA disability compensation, in which case it is waived. VA usually does not require an appraisal or income verification, though lenders can layer on overlays. And if you rent the place out now, you only need to certify you lived there before. The streamline is supposed to be boring. If the conversation suddenly turns to pulling equity out, you have left IRRRL territory, and you should ask the lender to explain exactly what product they are now quoting.

Arkansas VA IRRRL questions

Can I shop the title insurance on my Arkansas streamline?

Yes. Arkansas is an open-rate state, so title premiums are not set by the state and can differ between companies. Ask the lender who they use, then get at least one competing quote. Lower costs make the 36-month recoup test easier to pass.

Why does my wife have to sign if the Little Rock house is only in my name?

Arkansas law at ACA 18-12-403 has the spouse join the deed of trust to release dower, curtesy and homestead rights. That applies on a refinance, not just a purchase. Plan for both of you to sign or arrange a remote notary session together.

Is there a transfer tax on refinancing my VA loan in Arkansas?

No. Arkansas has no mortgage tax or transfer tax on a refinance. You pay recording fees, and the rest of your cost is lender charges, title insurance and the 0.5 percent funding fee unless you are exempt for disability compensation.

When does the money actually fund on an Arkansas IRRRL?

Arkansas is a wet-funding state, so the lender wires funds at signing. Those funds are held through the rescission window, and the old loan is paid after it closes. The timeline is usually tighter than in dry-funding states.

Will Home Loans Inc take my Arkansas application?

No. Home Loans Inc is not licensed in Arkansas and cannot take the application. Use this page to understand the rules, including dower signatures and shoppable title insurance, then choose a lender licensed in Arkansas and compare at least two quotes.
