North Carolina VA IRRRL: Streamline Refinancing Near Liberty and Lejeune
North Carolina layers attorney closings and a strong anti-predatory lending law on top of the VA IRRRL. Both work in your favor if you know what to expect.
Myths, busted
Four things a Tar Heel IRRRL does not need
A lot of my North Carolina calls start with a wrong assumption. Let me clear the deck.
- You do not need to live there now. PCS'd from Fayetteville to Fort Carson? Fine. You only certify you lived there at some point.
- You usually do not need an appraisal. VA generally skips it on a streamline, though a lender can add its own overlay.
- You usually do not need to prove income to VA. Same caveat on lender overlays.
- You do not get cash out. An IRRRL lowers the rate or stabilizes the loan. It does not hand you a check.
What you do need: a current VA loan, at least six payments made and 210 days since the first payment due date (whichever is later), and savings that pay back the costs within 36 months.
The funding fee is part of that payback math unless you are exempt. Get VA disability compensation and it drops to zero, which can turn a borderline deal into an easy one. Nobody pulls cash on a streamline, so there is no reason for the new balance to balloon.
Attorney state
A North Carolina lawyer supervises your closing
North Carolina requires a licensed attorney to supervise the closing and give the title opinion. That is true for every refinance here, IRRRL included. Funding is wet.
In plain terms, you will meet with or sign through a closing attorney. Their fee is part of your closing costs, and those costs go into the 36-month recoup test. A title reissue discount may apply if your prior policy is recent, subject to the underwriter. Ask about it if you bought in the last few years.
Spousal signatures
Why your spouse is at the table
Here is the North Carolina wrinkle. A spouse generally signs the deed of trust to release marital rights, even when not on the note. Only purchase-money loans are excepted, and a refinance is not purchase money.
So a non-borrowing spouse signs the security instrument and the right-to-cancel. A free-trader agreement or sole-and-separate vesting can change this, and your closing attorney will sort that out. The default assumption should be two signers.
Practical upshot for a Marine at Lejeune with a spouse on the other side of the country: tell me on day one. The right-to-cancel signature matters as much as the deed of trust, and missing one can stall the whole file.
Where NC's VA loans live
Base by base
Fort Liberty
Fayetteville and out into Harnett, Hoke and Moore County. The Army's largest installation by population.
Camp Lejeune
Jacksonville, Swansboro and Richlands in Onslow County. Marine families with VA loans everywhere.
MCAS Cherry Point
Havelock and New Bern in Craven County.
Seymour Johnson AFB
Goldsboro and Wayne County. Smaller market, same streamline rules.
Fort Barfoot sits up in Blackstone, Virginia, but some of its people live in the northern NC corridor. If your home is on the Carolina side, this page is yours.
Taxes and protections
Cheap to record, tough on bad loans
North Carolina imposes no state refinance tax on the loan. You pay recording fees. Simple.
The state also passed the first anti-predatory lending law in the country, GS 24-1.1E, with a net tangible benefit standard and housing counseling on covered high-cost loans. VA already demands a net tangible benefit on an IRRRL, so the two rules point the same direction: the refinance has to help you. Prepayment penalties are barred on owner-occupied 1 to 4 unit loans at or below the statutory threshold, and foreclosure here runs non-judicially through a clerk hearing.
Home Loans Inc holds North Carolina Mortgage Broker License #B-187320 in North Carolina. The funding fee is 0.5%, or zero with VA disability compensation. Send me your numbers and I will tell you if the streamline earns its keep.
North Carolina VA IRRRL questions
Why does my wife have to sign if she isn't on our North Carolina VA loan?
North Carolina generally requires a spouse to sign the deed of trust to release marital rights, even when not on the note. Only purchase-money loans are excepted, and a refinance is not one. She signs the security instrument and the right-to-cancel. A free-trader agreement or separate vesting can change that, so ask your closing attorney.
Is there a North Carolina tax on refinancing my VA loan?
No state refinance tax applies to the loan itself. You pay recording fees only. A title reissue discount may also be available if your prior title policy is recent, depending on the underwriter. Those lower costs help an IRRRL meet the VA rule that costs be recouped through monthly savings within 36 months.
Do I need a lawyer to close an IRRRL in North Carolina?
Yes. North Carolina requires a licensed attorney to supervise the closing and provide the title opinion on every refinance, including a VA streamline. The attorney fee is part of your closing costs. Funding is wet, meaning money moves at closing once the right-to-cancel period is respected.
I'm at Lejeune now but bought near Fort Liberty years ago. Can I streamline the Fayetteville house?
Yes, if that house still has a VA loan. The IRRRL only asks you to certify that you once lived in the home. Seasoning applies: at least 210 days past the first payment due date and six monthly payments made, whichever is later. The new loan must give you a real benefit.
How does North Carolina's anti-predatory lending law affect my IRRRL?
North Carolina's GS 24-1.1E sets a net tangible benefit standard and requires counseling on covered high-cost loans. VA already requires a net tangible benefit on every IRRRL, so the state law mostly reinforces what VA demands. A well-priced streamline is not a high-cost loan, but the benefit still has to be real.
