Short version
North Dakota in four cards
Who closes
A title or escrow company, though a licensed attorney must examine and certify title.
Who signs
On a homestead, both spouses generally join the security instrument.
What the state takes
No mortgage tax, no refinance tax. Standard recording fees.
Who cannot help
Home Loans Inc. We are not licensed in North Dakota and cannot take your application.
That last card is the blunt one. Everything below is education, so you can shop a North Dakota-licensed lender and catch the sloppy ones.
Minot, Grand Forks, Devils Lake
Bombers, missiles, and drones up north
Minot AFB runs B-52s and the Minuteman III ICBM wing. Grand Forks AFB flies the RQ-4 Global Hawk and handles space operations. Camp Grafton by Devils Lake trains the North Dakota National Guard.
Veterans from all three end up owning homes in Fargo, Bismarck, Minot, and Grand Forks. Minot's housing market rises and falls with oil prices and military assignments. On a purchase, that volatility would make an appraiser nervous. On an IRRRL, VA usually does not ask for an appraisal at all, so your value can wobble and you can still streamline, unless your lender adds its own appraisal requirement. Ask.
Bonus: the brutal winters do not matter here. Nothing is being built. You are swapping paper.
The checklist
Rules VA will hold you to
- Existing VA loan only. If your current mortgage is not VA, this is not your loan.
- Seasoning: 210 days from the first payment due date and at least six monthly payments made. The later date counts.
- Recoupment: closing costs paid back through monthly savings within 36 months.
- Benefit: VA requires a net tangible benefit. North Dakota relies mainly on the federal high-cost framework rather than a stricter state statute, so VA's test does the heavy lifting.
- Funding fee: 0.5%, waived if you receive VA disability compensation.
- Occupancy: you certify you lived there before. Reassigned from Grand Forks to the other side of the world? The house can still qualify.
- Income: VA usually does not verify it on a streamline. Lender overlays can change that.
Closing day
Why a lawyer looks at your title
North Dakota has a twist. A title or escrow company closes the refinance, but a licensed attorney must examine and certify title. You may never meet that attorney. Their work is part of your closing costs, and like everything else it counts toward your 36-month break-even.
North Dakota is wet-funding, so money moves at signing. On a homestead, both spouses generally must join the security instrument. A non-borrowing spouse signs the mortgage and the right-to-cancel and stays off the note.
Prepayment follows your note and federal limits, and most current first-lien refinances are penalty-free. The state uses judicial foreclosure, which you should never have to think about on a payment-lowering loan.
One practical tip. Because North Dakota adds that attorney certification step, ask early how long title work is running. A streamline is supposed to be quick, and title can be the piece that sets the pace.
Picking a lender
Questions for a North Dakota lender
Call a couple of North Dakota-licensed lenders. Ask each one for the rate, the total costs including the attorney title certification, and the month you break even. Ask whether they require an appraisal on IRRRLs. Ask whether your funding fee is exempt. If one of them gets weird when you bring up break-even, hang up. Politely. It is North Dakota.
Bring your current mortgage statement so they can confirm the loan is VA and see your payment history. Compare offers on the same day, since rates move. And if your spouse is not on title, say so on the first call, so the lender plans for the homestead signature instead of discovering it at the table.
North Dakota VA IRRRL questions
Why does an attorney certify title on a North Dakota IRRRL?
North Dakota requires a licensed attorney to examine and certify title even though a title or escrow company handles the closing. It is part of the normal process, not a sign of a problem. Ask how the cost appears on your estimate so you can factor it into the 36-month recoupment.
Minot home values swing with oil. Will that block my streamline?
Usually not. VA generally does not require an appraisal on an IRRRL, so short-term value swings matter less. Some lenders add an appraisal overlay, which could bring value back into play, so ask before applying. Home Loans Inc is not licensed in North Dakota, so use a North Dakota-licensed lender.
Does my spouse have to sign on our Grand Forks homestead?
Generally yes. In North Dakota both spouses usually must join the security instrument on a homestead. A non-borrowing spouse signs the mortgage and the right-to-cancel but does not join the note, so they are not taking on the debt.
Are there North Dakota state taxes on an IRRRL?
No state mortgage tax and no refinance tax. Expect standard recording fees only. With costs that low on the state side, your recoupment math mostly comes down to lender fees, the title work, and the 0.5% funding fee, which is waived if you receive VA disability compensation.
