Oklahoma VA IRRRL: Registration Tax, Homesteads and the Streamline

Oklahoma taxes the full new loan and voids homestead mortgages your spouse did not sign. Know both before you streamline.

The registration tax

Oklahoma taxes the whole new loan

Oklahoma charges a mortgage registration tax. It is tiered by loan term, and most 30-year refinances run about $1.00 per $1,000 of debt, plus a small certification fee. There is no carry-over device here, so a payoff refinance is taxed on the full new loan, not just the new money.

Not a huge number. But on an IRRRL every cost counts against VA's rule that closing costs come back through monthly savings within 36 months. Make the lender show the registration tax on your estimate and fold it into the break-even month.

Homestead

Both spouses sign, or the mortgage is void

Oklahoma does not mess around on homesteads. Both spouses generally must sign, or the mortgage is void. That is the kind of mistake that hides for years and then shows up at the worst possible moment.

Good news: your spouse does not have to be a borrower. A non-borrowing spouse signs the security instrument and the right-to-cancel without joining the note. Get both of you on the calendar before you lock. If your spouse travels for work or is deployed, raise it on the first call so the lender and title company have time to sort out how that signature will happen.

From Tinker to Fort Sill

Five installations, one streamline

Tinker AFB in the Oklahoma City metro is the Air Force Sustainment Center, the depot for KC-135s, E-3s and B-52s. Fort Sill in Lawton is the Army Fires Center, home of the artillery and air defense school. Altus AFB trains KC-46, KC-135 and C-17 crews. Vance AFB in Enid trains pilots. McAlester Army Ammunition Plant produces ammunition.

So VA homeowners are spread across Oklahoma City, Norman, Tulsa, Lawton, Enid and beyond. On a purchase, Lawton gets tricky once prices climb past about $350,000, because comparable sales thin out. On a streamline, VA usually does not need an appraisal, so that problem mostly disappears unless the lender adds an appraisal overlay.

Here is the part I cannot dress up. Home Loans Inc is not licensed in Oklahoma. I cannot take your application. Think of this page as a cheat sheet for shopping an Oklahoma-licensed lender.

How it closes

Title company at the table, attorney behind the scenes

A title or escrow company closes your Oklahoma refinance. Before the title policy issues, though, state law requires an attorney title opinion. Oklahoma is wet-funding, so money moves at signing.

Oklahoma applies the high-cost provisions of its consumer credit code along with a net-tangible-benefit standard. Prepayment terms follow your note and federal limits, and most current first-lien refinances are penalty-free. Oklahoma uses non-judicial foreclosure.

Practically, that means two pieces of title work, the opinion and the policy, and both land in your costs. Ask for the attorney title opinion fee by name so it does not hide inside a vague title charge. Then make sure the registration tax, the opinion, and the lender fees all sit inside the recoupment calculation, not next to it.

VA's side

The streamline rules in plain English

Seasoning

210 days from your first payment due date and six monthly payments made, whichever is later.

Cost

A 0.5% funding fee, waived if you receive VA disability compensation, plus the registration tax and normal closing costs.

Paperwork

VA usually requires no appraisal and no income verification. Some lenders add overlays anyway.

Occupancy

Certify you lived there before. PCS'd out of Altus and kept the house? You may still be eligible.

And it only works on an existing VA loan, with a net tangible benefit you can point to. Bring your current mortgage statement to the first call and make the lender do the math in front of you. If the break-even lands past 36 months once the registration tax is in, the deal is dead, and no amount of sales talk fixes that.

Oklahoma VA IRRRL questions

How is Oklahoma's mortgage registration tax figured on an IRRRL?

It is tiered by loan term. Most 30-year refinances run about $1.00 per $1,000 of debt plus a small certification fee. Oklahoma has no carry-over device, so the tax applies to the full new loan amount. Ask the lender to include it in your 36-month recoupment calculation.

What if my spouse misses the signing on our Oklahoma homestead?

That is a serious problem. On an Oklahoma homestead, both spouses generally must sign or the mortgage is void. A non-borrowing spouse signs the security instrument and right-to-cancel without joining the note. Schedule the closing so both of you can sign.

Why does my Oklahoma refinance need an attorney title opinion?

State law requires an attorney title opinion before the title policy issues, even though a title or escrow company closes the loan. It is a standard step. Home Loans Inc is not licensed in Oklahoma, so ask your Oklahoma-licensed lender how that cost shows up on your estimate.

I bought near Fort Sill. Will thin Lawton comps hurt my streamline?

Probably not. VA usually does not require an appraisal on an IRRRL, so comparable sales rarely come into play. A lender overlay requiring an appraisal could change that, so ask before applying. Your loan still needs to be VA, seasoned, and able to recoup costs within 36 months.
