Minnesota VA IRRRL: Count the Registry Tax Before You Count the Savings

Minnesota charges a tax on the full new loan when you refinance, and that changes the IRRRL math. Home Loans Inc is not licensed in Minnesota, but here is how to judge a streamline offer there.

The cost nobody mentions

Minnesota taxes the whole new loan

Most states charge a flat fee to record a refinance. Minnesota charges a Mortgage Registry Tax of 0.23 percent, about two dollars and thirty cents per thousand. And on a standard payoff-and-replace refinance, it applies to the full new loan amount, not just new money.

There is no carry-over device to shrink it either. A normal refinance re-pays the tax on the entire new balance. You already paid it once when you bought. You pay it again now.

Why I lead with this: VA requires that your closing costs be recovered through your monthly savings within 36 months. The registry tax is a cost. Put it in the math. A streamline that looks great before the tax might look merely fine after it, and a lender who leaves it off the estimate is setting you up for a surprise.

Homestead joinder

Both of you sign. Plan for it.

Minnesota is a homestead-joinder state. On a homestead refinance, both spouses generally must sign, even if only one is on title. There is a purchase-money exception, but it does not extend to a refinance. So the spouse who skipped the original signing because of that exception does not get to skip this one.

Closing is handled by a licensed closing agent or title company, and no attorney is mandated. Funding is wet, so money generally moves at signing, subject to the federal right-to-cancel window on your primary residence.

Two more Minnesota guardrails

Fee caps and a disclosure read out loud

Financed fees capped at 5 percent

Minnesota caps financed fees at five percent. On a streamline, where the whole point is lower cost, you should be nowhere near it. If you are, ask why.

A prepayment disclosure, read aloud

Minnesota requires a read-aloud prepayment disclosure. Do not tune it out. Listen, and ask questions if anything sounds off.

Foreclosure in Minnesota is non-judicial, by advertisement. None of that should matter on a healthy VA loan, but it is good to know which rules apply to your house.

Who and where

From Camp Ripley to the Twin Cities

Minnesota's military presence is mostly Guard and Reserve. Camp Ripley in Little Falls is the largest National Guard training site in the state. The Minneapolis-Saint Paul air reserve station flies Air Force Reserve C-130s. Duluth ANGB is home to the 148th Fighter Wing.

The Twin Cities metro is the strongest market. Rochester, the Mayo Clinic city, is growing. Duluth is smaller and northern. St. Cloud is moderate and affordable. Rural Minnesota is thin on sales history, but a streamline usually skips the appraisal, so that rarely gets in the way.

The VA list, and the license

What has to be true, and why I am not your lender

Your current loan must be a VA loan. You need at least 210 days since your first payment due date and at least six payments made, whichever is later. The new loan has to show a net tangible benefit. The funding fee is 0.5 percent, or nothing if you receive VA disability compensation. VA usually does not require income verification, although lenders may. You only certify that you lived there before.

Home Loans Inc is not licensed in Minnesota and cannot take a Minnesota application. Take this page to a Minnesota-licensed lender, and make them show the registry tax on the estimate before you talk about anything else.

Winter tip from a guy who likes warm weather: remote options and scheduling matter when the roads are bad. Ask how the signing works if both spouses cannot make it to the same office on the same day, since both signatures are usually required on a Minnesota homestead.

Minnesota VA IRRRL questions

How much is the Minnesota mortgage registry tax on a VA streamline?

Minnesota charges 0.23 percent, about two dollars and thirty cents per thousand. On a standard payoff-and-replace refinance it applies to the full new loan amount, not just new money, and there is no carry-over device to reduce it. Include it when you check the 36-month recoupment.

Does the purchase-money exception mean my spouse can skip signing the refinance?

No. Minnesota is a homestead-joinder state, and on a homestead refinance both spouses generally must sign even if only one is on title. The purchase-money exception applies to purchases and does not extend to a refinance.

What is the read-aloud prepayment disclosure in Minnesota?

Minnesota requires a prepayment disclosure to be read aloud to the borrower. It is a consumer protection meant to make sure you understand any prepayment terms. Listen carefully and ask questions before you sign anything you do not fully understand.

Will Home Loans Inc take a Minnesota IRRRL application?

No. Home Loans Inc is not licensed in Minnesota and cannot take a Minnesota application. This page is for education. Compare Minnesota-licensed lenders, and make sure every estimate includes the registry tax before you judge the savings.
