Nevada VA IRRRL: Escrow, Community Property and the Streamline

How the VA rate-reduction refinance plays out in Nevada, where escrow dry-funds and your spouse almost always signs.

Home Loans Inc is not licensed in Nevada and cannot take a Nevada application. We lend in South Carolina, North Carolina, Virginia, West Virginia, Florida, Georgia, Alabama, Mississippi, Iowa and Wyoming.

Escrow, Nevada style

Why a Nevada refi takes a few extra days

Most veterans think closing day is the finish line. In Nevada it is closer to the start of a countdown. Nevada is an escrow state and it dry-funds. You sign. The documents record. Then, days later, the money moves.

If the home is your primary residence, stack the federal three-day right to cancel on top of that, and you can see why Nevada closings feel slow. Nothing is broken. That is just the order of operations here. If a payment due date is close, ask the escrow officer to walk you through the timing so you know which loan your next payment goes to.

Community property

Your spouse is signing. Plan for it.

Nevada is a community-property state. To encumber community real estate, both spouses generally join. So even if your husband or wife is nowhere on the loan, expect them to sign the security instrument and the right-to-cancel.

Signing does not make them a borrower. The note stays yours. But they need to be available when escrow schedules the signing, and a spouse who is deployed or working odd shifts needs a plan. Ask escrow early what they will accept if your spouse cannot be there in person.

Vegas to Fallon

The bases behind Nevada's VA borrowers

Southern Nevada has a deep bench of VA homeowners. Nellis AFB in Las Vegas runs the USAF Warfare Center and hosts Red Flag. Creech AFB out at Indian Springs flies MQ-9 Reapers. The Nevada Test and Training Range, the largest military training range around, covers a big piece of southern Nevada. Up north, Naval Air Station Fallon is home to TOPGUN and the Naval Strike and Air Warfare Center.

If you bought with a VA loan anywhere from Henderson to Reno to Fallon and rates have dropped since, the IRRRL is your tool. It does not care much about your neighborhood, because VA usually waives the appraisal. That matters in a small town like Fallon, where home sales are thin and a valuation could turn into a headache. If a lender insists on appraising anyway, that is their overlay, not a VA rule, and you can shop around it.

The rules

What VA actually checks on a streamline

Is it already VA?

An IRRRL refinances an existing VA loan and nothing else. Carrying a conventional or FHA loan today? Different product, different page.

Has it seasoned?

Count 210 days from your first payment due date and six monthly payments made. Whichever lands later is your earliest shot.

Does it pay you back?

Closing costs must be recouped through monthly savings within 36 months, and the deal needs a net tangible benefit.

What does it cost?

The funding fee is 0.5% of the loan. Zero if you receive VA disability compensation.

VA usually skips income verification too, and you only certify that you lived in the home at some point. Got PCS orders out of Nellis and kept the house as a rental? You may still qualify.

Who can help you

Home Loans Inc cannot take this one

I will be blunt. Home Loans Inc is not licensed in Nevada, so I cannot take your application. Use what you learned here and collect quotes from Nevada-licensed lenders.

Nevada has its own high-cost home-loan statute and applies a net-tangible-benefit standard, so a good lender will document exactly how you come out ahead. Taxes are simple: no state mortgage or refinance tax, recording fees only. You may also get a reissue or refinance discount on the title policy, depending on the title underwriter. Ask for it by name.

Last note. Nevada uses non-judicial foreclosure. That should never come into play on a loan whose whole purpose is shrinking your payment, but you should know the ground you are standing on.

Nevada VA IRRRL questions

Why did my Nevada IRRRL record but not fund yet?

Nevada is a dry-funding escrow state. Documents are signed and recorded first, and funds disburse days later. On a primary residence the federal three-day right to cancel also applies, so the waiting stacks up. It is normal. Ask your escrow officer for the expected funding date while you are at the signing.

My wife is not on the loan. Does she sign anything in Nevada?

Usually yes. Nevada is a community-property state, so both spouses generally join to encumber community real estate. A non-borrowing spouse typically signs the security instrument and the right-to-cancel but not the note, which means she does not take on the debt itself.

I left Creech on orders and rent out my Vegas house. Can I streamline it?

Possibly. For an IRRRL you only certify that you previously lived in the home. You still need an existing VA loan, 210 days and six payments of seasoning, and costs recouped within 36 months. Home Loans Inc is not licensed in Nevada, so take this to a Nevada-licensed lender.

Is there a title insurance discount on a Nevada refinance?

There may be. A reissue or refinance discount on the title policy can apply, subject to the title underwriter. Nevada charges no state mortgage or refinance tax, so recording fees and title costs are the main state-side items. Ask each lender to show the discount on your estimate.
